Commissions will expire on your birthday and you will have to apply for a new commission since there is not renewal process. How to become a notary in Michigan?
To become a notary in Michigan, you have to complete the Notary Application and submit this with a $10.00 fee to the county clerk where you reside. In addition, you must obtain a notary bond covering $10,000 and take the oath of office. Within the 90 days of your application being approved, the notary bond must be sent to the Michigan Department of State of the Great Seal.
Who can become a notary in Michigan?
- Anyone who is 18 years old or older
- Be a legal resident of Michigan or maintain a place of business
- Must be a U.S. citizen or have proof of legal residence
- Be a resident of the county you request appointment in (if you do not reside in Michigan, maintain a business in the county of appointment request)
- Must be able to read and write in the English language
- Must not have any felony convictions in the past 10 years
- Must not have been convicted of two or more misdemeanor offenses involving a violation of the Michigan Notary Public Act within a 12-month period while commissioned or three or more misdemeanor offenses of this Act in the past 5 years.
Where may I conduct my notary services? Anywhere in the state of Michigan.
Who can I notarize for? You can notarize for any member of the public who meets all of the requirements for the notarization (must have proof of identity and be physically present)
Is there any training needed to be a Michigan notary public? No exam is required, however, the state of Michigan makes it mandatory for all Michigan notaries to read the current statues that regulate notarial acts.
Do I need a notary bond or E&O Insurance? All Michigan notaries must obtain a $10,000 notary bond (surety bond). The notary bond must be filed in the county of appointment. However, licensed attorneys are not required to have a notary bond if they hold good standing with the state of Michigan. This can be done by including your state bar number with your notary application.
E&O insurance is not required but recommended. Errors and Omissions Insurance will cover legal fees and damages up to the amount of the policy.
